1. Day Out With The Kids membership
1.1. Day Out With The Kids Ltd, of 3&4 Regal Court, 6 Sovereign Road, Kings Norton Business Centre, Birmingham, B30 3FJ, operates the website www.dayoutwiththekids.co.uk and its membership scheme at https://members.dayoutwiththekids.co.uk
1.2. This page describes the terms and conditions on which we supply Day Out With The Kids memberships, and on which you become a member of Day Out With The Kids
1.3. Please read these terms and conditions carefully and make sure that you understand them, before becoming a Day Out With The Kids member. You should understand that by signing up to become a member, you agree to be bound by these terms and conditions. You should print a copy of these terms and conditions for future reference.
1.5. By becoming a Day Out With The Kids member, you warrant that you are legally capable of entering into binding contracts and you are at least 18 years old.
1.6. We reserve the right to amend these terms and conditions at any time by giving you notice by posting the amended terms and conditions on our site.
1.7. After you sign up for a Day Out With The Kids membership, you will receive an email from us acknowledging that you have become a member.
2. Membership renewal & cancellation
2.1. The Day Out With The Kids membership is an ongoing subscription service, so your membership is continuous and renews automatically.
2.2 For monthly subscriptions with a paid trial month, your membership will renew each month on the same calendar date you signed up - i.e. if you signed up on 15th May, it will renew on 15th June. If the date you signed up does not exist in any given month - for example, if you sign up on the 31st August - then it will renew on the last day of the month, i.e. 30th September.
2.3 For monthly subscriptions with a free 14 day trial, your membership will renew each month on the date following the end of the free trial - i.e. if you signed up on 15th May, your first payment would be on 29th May and it will renew on 29th June. If the date you signed up does not exist in any given month - for example, if your first payment on the 31st August - then it will renew on the last day of the month, i.e. 30th September.
2.4 For annual subscriptions, your membership will renew on the same calendar date of the original signup in the following year.
2.5 Your renewal date and subscription type is displayed under the "My Account" section when logged in to https://members.dayoutwiththekids.co.uk. You should make yourself aware of your renewal date. Please be aware that Day Out With The Kids do not send out subscription renewal reminders.
2.6 If you would like to cancel your membership, you must visit https://members.dayoutwiththekids.co.uk/my-account and follow the "Cancel Subscription" link under the "My Subscription" section. If you have any issues with this process, please email us at firstname.lastname@example.org
2.7 Day Out With The Kids will respond with an email confirming your membership cancellation date no later than 5 working days from the date notice of cancellation is served. Your cancellation date will be the next renewal date following receipt of your cancellation email.
2.8 In the event of cancellation, you will be able to use your membership incentives up until the day before your final cancellation date. Following this, access to the offer claims will be removed.
3. Consumer rights
3.1 You have the right to cancel your membership with us within 14 days of your original signup. This does not apply to subsequent renewals. From time to time certain promotions may have different requirements regarding the cancellation period. Specific cancellation policies will be detailed throughout the purchase process.
3.2 If you cancel your membership within the 14 day cooling off period you will be charged a pro-rata fee for costs incurred during your period of membership. Any refunds given under the 14 day cooling off period will be provided less this pro-rata fee.
3.3 Subject to any other statutory rights you may have, we do not provide refunds for any cancellations after the expiry of the cooling off period.
3.4 Access to member incentives will be removed immediately following cancellation if within the 14 day cooling off period.
4. Payment and pricing
4.1. The price of membership will be as quoted on the website at the point of signing up, except in cases of obvious error. Prices include VAT.
4.2. We may change the price of membership from time to time; however, any price changes will apply no earlier than 30 days following notice to you via email.
4.3. Payment is by credit or debit card, or occasionally through use of online payment services such as Paypal. We will charge your card at the point you sign up to become a Day Out With The Kids member, and then on subsequent renewal dates for the lifetime of the membership.
4.4 Day Out With The Kids reserves the right to withdraw access to the membership website area and partner incentives in the event of failed or non-payment
4.5. Day Out With The Kids accepts no liability for banking charges incurred as a result of the membership fee being taken
5. Partner incentives
5.1. The Day Out With The Kids membership grants access to partner incentives at participating venues and websites via the logged-in area of https://members.dayoutwiththekids.co.uk
5.2. Each participating partner may stipulate individual terms & conditions specific to their incentive. These are displayed at the relevant points when claiming the incentive.
5.3. Participating partners are entitled to withdraw from the membership or to change the terms and conditions of incentives and their availability after you have become a member
5.4 Day Out With The Kids shall have no liability for any such withdrawals or changes in partner terms and conditions
5.5. We will use reasonable endeavours to update the membership website to show the particulars of participating partners and the terms of their availability
5.6. Members will benefit from incentives given by any additional participating partners which join the membership at a later date following initial signup, plus new incentives and their availability
5.7. Any online or printed marketing material is intended as a guide to partners who are participating at the time of publication, and therefore may not include all incentives at any one time
6. Proof of membership
6.1. Incentives displayed within the Day Out With The Kids membership website are only available to people with an active Day Out With The Kids membership and their companions, in accordance with any individual terms and conditions stipulated by the partner.
6.2. Members may be asked to prove their membership at any participating partner venue before the incentive is redeemed, including that their named identification matches the name of the Day Out With The Kids membership holder.
6.3. Day Out With The Kids memberships are strictly non-transferable. Any attempted misuse of membership may result in Day Out With The Kids imposing cancellation.
7.1. If Day Out With The Kids fail to comply with these terms and conditions, Day Out With The Kids shall only be liable for the membership fee and nothing further
7.2. Day Out With The Kids accept no liability arising out of, or in connection with, the experience when redeeming a partner incentive. We will not get involved in disputes between our members and partners
7.3. We do not give any warranty for any goods or services accessed through, or displayed on, our site.
